Código y sistemas jurídicos. Sus proyecciones en el Código civil y comercial argentino.
Sumario:
La autora afirma la categoría de sistema jurídico que numerosa doctrina atribuye al Derecho romano y, de Subsistema, al Derecho Latinoamericano. Trabaja brevemente la noción de sistema, sistema jurídico y sistema normativo y la correspondencia entre sistema y código. En el marco de la codificación y la descodificación se ubica al Derecho privado argentino. Finalmente, se analiza el nuevo Código civil y comercial, como código de principios, que presenta diferencias sustanciales con la codificación decimonónica.
Abstract:
The author states that Roman Law has the category of a legal system in accordance to what the mayority of schollars think and states that Latin American Law is a subsystem. She works briefly with the notions of system, law syste and rules system and with the correspondence between system and code. Argentinian private law is set within the frame of codification and decodification. Finaly, the new Civil and Commercial Code is analized, as a code of principles, which represents a substantial difference from 19th Century codification.
